Idaho’s Republican-dominated state House of Representatives voted 46-24 Monday to pass a resolution to reject same-sex marriage, despite the U.S. Supreme Court’s 2015 landmark ruling in Obergefell v Hodges.

In 2006, Idaho voters passed an amendment to the state Constitution to define marriage as a union between a man and a woman, though the Supreme Court’s ruling nearly a decade later found that such laws violate the 14th Amendment’s equal protection and due process guarantees.

A state legislative committee has advanced a resolution asking that the power to regulate marriage be returned to the states.

The target of the memorial is the high court’s 2015 decision Obergefell v. Hodges, which legalized same-sex marriage nationwide. If passed by both chambers, the memorial calls on the Legislature to ask the court to overturn the ruling.

Idaho lawmakers are introducing a flurry of legislation this session, including a memorial asking the U.S. Supreme Court to allow states to make their own decisions over how marriage should be defined.

The memorial would call on the Supreme Court to “restore the natural definition of marriage, a union of one man and one woman."
